Welcome to ChatDesh! Please read these Terms of Service carefully before using the ChatDesh website and chat service located at https://chatdesh.in.

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors and users who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Use of Service

ChatDesh provides online chat rooms for users to communicate based on language preferences. The Service is offered free of charge.

You do not need to register an account to use the basic chat features. You will be asked to choose a temporary username upon joining a chat room. You are responsible for the username you choose and ensuring it does not violate these Terms.

2. User Conduct and Content Rules

You are solely responsible for your conduct and any data, text, information, usernames, graphics, photos, profiles, audio and video clips, links ("Content") that you submit, post, and display on the ChatDesh service.

You agree **not** to use the Service to:

• Transmit any Content that is unlawful, illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Harm minors in any way.
• Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Post unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
• Transmit any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Stalk or otherwise harass another user.
• Collect or store personal data about other users in connection with the prohibited conduct and activities set forth above.
• Share or solicit personal contact information (including but not limited to phone numbers, email addresses, physical addresses, social media handles) within public chat rooms.
• Engage in any activity that is sexually suggestive, exploits, or endangers children.
• Violate any applicable local, state, national, or international laws or regulations.

3. Moderation and Enforcement

ChatDesh aims to foster positive and respectful communities. While we are not obligated to monitor all content or conduct, we reserve the right to do so.

We reserve the right, in our sole discretion, to:

• Remove any Content that we determine violates these Terms or is otherwise harmful or objectionable.
• Warn users regarding their conduct.
• Temporarily or permanently block users from accessing specific chat rooms or the entire Service.
• **Implement permanent IP address blocks** for users who engage in severe or repeated violations of these Terms, including but not limited to illegal activities, severe harassment, spamming, or attempts to disrupt the Service. IP blocking is a measure taken to protect the integrity of the Service and the safety of its users.
• Cooperate with law enforcement authorities or court orders requesting or directing us to disclose the identity of anyone posting any materials, or allegedly violating the law.

Decisions regarding moderation and enforcement are made at our discretion and are final.

4. Content Responsibility and Disclaimers

You understand that all Content, whether publicly posted or privately transmitted, is the sole responsibility of the person from whom such Content originated. This means that you, and not ChatDesh, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Service.

ChatDesh does not control the Content posted via the Service and, as such, does not guarantee the accuracy, integrity, or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent, or objectionable. Under no circumstances will ChatDesh be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted, or otherwise made available via the Service.

The Service is provided "AS IS" and "AS AVAILABLE". We do not warrant that the service will be uninterrupted, timely, secure, or error-free.

5. Privacy

6. Intellectual Property

7. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall ChatDesh, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
